The case

Everyone likes a good deal. But if a “sale” price is always the price — and no one has ever paid the “regular” price — then it’s not a deal. It’s a deception.

The complaint alleges that Build A Sign LLC has run that same playbook eleven times over: advertising crossed-out “regular” prices across an eleven-brand portfolio of custom-printing e-commerce sites, when the products were never actually sold at the higher price.

The action is brought under the D.C. Consumer Protection Procedures Act on behalf of a proposed class of D.C. consumers, and seeks injunctive relief and damages.
